Caroline is employed as a senior solicitor within our Family Law Unit.
She primarily deals with clients in relation to the breakdown of their marriage, and provides detailed advice in relation to financial provision following a separation. Such advice may cover transfer or sale of the matrimonial home, pension sharing orders, capital sum payments, child support and alimentary obligations, parental rights and responsibilities, and residence & contact issues for parents and other relevant persons. Specific issues, such as change of name or payment of school fees can also be addressed. She can also advise on issues where, for example, matrimonial property has been acquired with non-matrimonial resources, where various assets are used in the context of a business, whether that be for example a limited company or Partnership, or where previously ring-fenced assets have entered the domain of matrimonial property. She also advises on the preservation on pre-marital assets and has extensive experience acting for high net worth individuals.
Caroline also has extensive experience drafting the terms of pre-nuptial agreements in anticipation of marriage, and post nuptial agreements, for those perhaps considering reconciliation after a trial separation or where assets have been acquired during the period of marriage which one party seeks to exclude from the matrimonial pot. This for example can cover gifts, inheritance or acquisition of different assets from such non-matrimonial sources.
Caroline regularly advises clients in relation to cohabitation agreements and issues resulting from the breakdown of a cohabiting couple’s relationship, such as payment of a capital sum, the economic burden of childcare or provision on intestacy.
Caroline deals with both contentious and non-contentious cases. She has significant court experience, both in relation to financial issues and in cases involving children, such as appearances at child welfare hearings. She, like all other members of our Family law team, is trained as a family collaborative lawyer and is a member of the Scottish Collaborative Family Law Group also a member of the Family Law Association in Scotland.
