Latest Edition: Mental Health Issues; Sick Leave & Annual Leave
A recent case has seen a local authority attempt to sue its former chief executive for £1million, accusing her of lying about her medical background when she applied for the job. The case was described as “novel” by the judge who heard it, while campaign organisation MIND said it is "an important reminder to employers of their obligations to provide adequate support to those with mental health problems in the workplace”. Laura Morrison, a senior solicitor in the Employment Team discusses the issues arising.
Then, as employees’ thoughts turn to summer holidays, bosses are confronted by the logistical challenge of maintaining service levels with a depleted workforce. For those organisations also managing long-term sick leave, the issues surrounding holiday entitlements have the potential to become a more serious headache thanks to a set of holiday pay claims against Her Majesty’s Revenue and Customs (HMRC). Louise Taggart, an Associate in the Employment Team, outlines the implications of the judgments in the case.
